Section 5
Matters to be taken into account by the Court itself
(1) The court shall take judicial notice of the following matters (a) Territory of Nepal,
(b) Constitution of Nepal and Nepal Law,
(c) National flag of Nepal,
(C1) National Anthem of Nepal,
(C2) Seal of Nepal,
(d) Oath of the President,
(e) date of attestation of the Bill,
(f) Notices published in the Nepal Gazette.
(2) The court shall take judicial information on matters of common knowledge which cannot be the subject of dispute. However, according to this sub-section, if any party to the case requests the court to take judicial notice of a matter, the court may order that party to submit the necessary evidence in that regard, and the court may refuse to take judicial notice of the matter until such evidence is submitted to the satisfaction of the court.
(2A) Except in the case of sub-section (2), the parties shall not adduce evidence on matters which the court takes judicial notice of.
(3) The court may take the help of necessary books or documents to obtain judicial information under this section.
